Description:
Medical Malpractice - Plaintiff claimed she developed chronic pain in her hip caused by a negligently performed operation. Plaintiff sought treatment for a bluish discoloration of her toes on her left foot caused by poor circulation. She was referred to Dr. J. Lionel Bre, a general surgeon who recommended an performed surgery to remove fatty deposits from an artery in her leg. As a result of the operation, fatty deposits became lodged in the right femoral artery. Plaintiff claimed some pain in the right leg to nurses following the surgery after midnight on the day of the day of the first surgery. The nurses called Dr. Bre who gave verbal orders. He did not come into the hospital until the morning of the next day when he ordered other tests and a second operation was performed at 1:00. The plaintiff claimed that she had damage to her sciatic nerve as a result of the delay of approximately 12 hours from the time of her complaints to the time of the procedure to correct the complaints. The doctor did not come to the hospital to check on plaintiff's condition until the next afternoon.

A second operation was later performed by Dr. Bre to unclog the artery. Unfortunately, plaintiff's sciatic nerve was damaged by a lack of blood to the nerve causing chronic pain and numbness.

Defendant denied wrongdoing and asserted that plaintiff did not use the cane in private.
