Description:
Tina Shupe, age 38, sued Carilion Clinic and Dr. Zev Elias on medical malpractice (medical negligence) and respondeat superior theories claiming that Dr. Elias performed the wrong type of surgery on a herniated disc in her back. Plaintiff claimed that as a direct result she has experienced continuing back pain. Shupe ruptured a disc in her back in 2007 when she lifted a bariatic bedside commode while working as a respiratory therapist at Wythe County Community Hospital. She claimed that the botched surgery has caused her to be unable to work and sometimes has to use a wheelchair.

Defendants denied wrongdoing and asserted that it was unlikely that Shupe would have have a good outcome in any event.
