John Elias, individually and on behal of the Estate of Sabine Elias sued Dr. Dina Weiss and Dr. Jyoti Ganguly on a medical malpractice theory for the wrongful death of his wife. Mrs. Elias died a few days after giving birth to a healthy baby at St. John's Episcopal Hospital in Smithtown, New York from what the plaintiff claimed was blood loss caused by damage to a blood vessel during a C-section surgery. An autopsy revealed massive amounts of blood in the woman's abdomen and abdominal wall. Plaintiff claimed that Dr. Weiss, an obstetrician, and Dr. Ganguly both acted below the standard of care in their treatment of Mrs. Elias. Plaintiff claimed that Weiss failed to act when Ganguly, a cardiologist, determined that bleeding was the probable cause of the patient's post partum problems. In addition, Elias asserted that Ganguly was negligent in failing to intervene on behalf of the patient when Weiss failed to act on the information provided by Ganguly.
