George Kidd sued Michael Tomko Jr., and his employer Magnesium Elecktron Inc. on negligence and respondeat superior liability theories claiming that Tomko failed to exercise due care in the operation of the tanker truck that he was driving on February 2, 2004 and that as a direct result Tomko hit Kidd, who was standing on a sidewalk with his bicycle when he was hit by the truck. Kidd was hospitalized for months for treatment of broken legs and other injuries.
The defenses asserted that Kidd was intoxicated and rode his bicycle into the rear of the truck causing his own injuries.
