Description:

Injunction - Breach of Contract: Plaintiff, owner of a hotel property, entered into a management contract with defendant to provide management services for plaintiff's hotel property. Shortly after commencement of performance under the management contract, plaintiff noted deficiencies and defects in defendants performance, including, defendant's agents attending "expensive" conventions where defendant was said to have promoted its own services to other companys and expensed the travel and convention fees to plaintiff. Plaintiff filed suit for an injunction against defendant in providing management services under the contract. A temporary injunction was implemented. Defendant counterclaimed for lost wages and fees under the terms of the contract, $48,000 in lost wages and $11,102.40 in attorney fees.

Against plaintiff on the injunction and for the defendant for lost wages and attorney fees under the contract totalin 59,102.00.
