Description:
Emanuel Badger sued Montefiore Medical Center and others on a medical negligence (medical malpractice) theory for failing to diagnose and treat him on May 1, 2002 when he visited the emergency room at the hospital seeking help. He was

diagnosed with a strain of flu and sent home. Days later he returned because his condition had worsened. This time a blood test was ordered and it was determined that he had a staph infection which had developed pericarditis. Emergency surgery on his heart surgery was performed and a valve was replaced to save his life.
