Gass, Jon David Astacio, Tulsa Security Patrol and Action Helicopters infringed Motorola's copyrights and trademarks by possession and using unauthorized copies of Motorola's Radio Service Software, which is used to reprogram the operating characteristics of Motorola's microprocessor-controlled two-way radios. Motorola further alleged that Defendants used the software to reprogram police scanners to monitor law enforcement and other emergency radio frequencies. Motorola also claimed that Defendants used Motorola's logos and trademarks without permission from Motorola in dealing with their customers to create the false impression that the radios being offered for sale originated from or were approved by Motorola.
