Jane Doe v. Bennington County

Plaintiff sued the Bennington County Sheriff's Department claiming that she was damaged after being sexually attacked by a sheriff's deputy. She claimed that Richard Forrest, the Sheriff's bother, forced her to perform oral sex on him while he was on duing at the East Dorset General Store where she work in 1997. She claimed that she was emotionally permanently injured as a result of being forced to perform oral sex on the officer and suffers from depression and post-traumatic strees disorder. She claimed that Forrest pointed a gun at her head while she was on her knees in front of him doing what he ordered. The deputy resigned and plead guilty to lewd and lascivious conduct in 1998.

The defendant denied that Richard Forrest was acting within the scope and course of his employment at the time of the incident and further denied that it was negligent in any way in hiring, training and/or supervising the duty and should not, therefore, be held liable for his tortious and criminal acts.
