Margaret Pendergast, age 66, sued Mary Jane Neveu on a negligence theory claiming that defendants failed to use due care in the operation of her automobile and, as a result, lost control of her vhicle causing it to collide

that she sustained a broken collarbone and was hospitalzed for three days for treatment.
Defendants denied that she was negligent and claimed that she lost control of her vehicle after hitting a patch of black ice.
