Description:
The family and estate of Ken Christiansen sued Wesley W. Omer, Kevin J. McGuigan and Brian G. Warden on negligence theories claiming that the defendants failed to exercise due care when they gave the 19-year-old alcohol at a rugby team party. Christiansen was later found dead in Chester Creek three days after the party on April 13, 2001. It was theorized that Christiansen tried to cross the swollen creek in the dark and fell in. His face had been marked with a black permanent marker, part of an initiation ritual that rugby team members participated in at the party. He drank beer for up to 5 1/2 hours at the party and had a blood-alcohol content of 0.216 percent. Defendants were all adults. McGuigan was president of the club rugby team, Warden was treasurer and Omer was captain.
Outcome:
Settled for $150,000.00.
