Grounds for Divorce
Oklahoma recognizes both fault and no-fault grounds for divorce.
Fault Grounds: Adultery, abandonment for one year, extreme cruelty, habitual drunkenness, gross neglect of duty, and others.
No-Fault Grounds: Incompatibility of the parties, which is a no-fault ground indicating a complete breakdown of the marriage.
Residency and Filing
Residency: You must have lived in Oklahoma for at least six months before filing for divorce.
Filing: A Petition for Dissolution of Marriage must be filed with the district court.
Service: You must properly serve the filed papers on your spouse through a process server, sheriff, or certified mail.
Waiting Periods
No Children: A divorce can be finalized as quickly as 10 days if there are no children involved and the parties agree on all issues.
Children Involved: A mandatory 90-day waiting period begins from the date of filing before a final order can be issued. This period can be waived if neither spouse objects or if they've completed counseling and the court finds it unlikely they will reunite.

Equitable Distribution: The court will divide marital property (assets and debts acquired during the marriage) in a fair and just manner, which is not necessarily 50/50. Separate property (owned before marriage) is generally not subject to division.
