COME NOW the Plaintiffs and for this their claims and causes of action against the Defendants, and each of them, allege and state as follows:
COUNT ONE
That the facts which give rise to this cause of action occurred in Tulsa County,
That Plaintiffs, Karen A. and Walter L. Wheelock, have at all times materiaJ:-:.h-!-U,"ein-, '
been husband and wife. 1)
That the Defendant Paul G. Hagood, M.D., is a licensed physician in the State of
Oklahoma, holding himself out as a person competent to render the care and treatment to the Plaintiffs.
That the Defendant AHS Oklahoma Physician Group, LLC, is a limited liability company, doing business as Utica Park Clinic, is an institution authorized by law to render medical care and attention to persons, and, at all times material herein, was acting by and through its agents, servants and employees who were within the scope and appointment of their agency and authority.
That the Defendant AHS Hillcrest Medical Center, LLC, is a limited liability company that was, at all times material herein, acting by and through its agents, servants and employees who were within the scope and appointment of their agency and authority, and operated a hospital under the name of Hillcrest Medical Center.
That this Court has jurisdiction of the parties and the subject matter of this action.
That on or about the 121 day of December, 2013, the Defendants undertook to
render medical care and treatment to the Plaintiff Karen A. Wheelock, and perform a procedure known as a laproscopic sacral coloplexy with robot assistance.
That as a result of the gross negligence of the Defendants, and each of them, in the permitting and performance of the above described procedure and subsequent care, the Plaintiff Karen A. Wheelock did suffer serious, painful, and disfiguring personal injury, which has prevented her from transacting her business, and forced her to expend large sums of money to effect a cure for her injuries.
That as a result of the gross negligence of the Defendants, and each of them, Plaintiff Karen A. Wheelock has lost and will lose wages and suffered a loss of earning capacity, has incurred and will incur expenses for medical care and attention, and has endured and will endure pain and suffering.
That at the time of the gross negligence of the Defendant, and the resulting injuries to the Plaintiff Karen A. Wheelock, she was 63 years of age, with a life expectancy of 22.0 years, according to the United States Life Tables.
COUNT TWO
That as a result of the gross negligence of the Defendants, and each of them, Plaintiff Walter L. Wheelock did suffer a loss of society, consortium and companionship of his wife.
WHEREFORE, premises considered, Plaintiffs, and each of them, do pray for judgment against the Defendants, and each of them, each in a sum in excess of $10,000 actual damages, and in a sum in excess of $10,000 punitive damages, together with interest, costs of this action, and for such other relief to which they may be entitled.
