Oklahoma City, OK - James S. Matthews, Jr. and Valerie Matthews sued Edwinna Moore seeking specific performance claiming:
1. On September 5, 2014, Plaintiffs as buyers and Defendant as seller entered into a written contract for the sale of real property, which included a house and other improvements, commonly knovm as 2633 NW 3 8'h St, Oklahoma City, Oklahoma, with a a legal description as follows:
West 55' of Lot Nine (9), Block Fifieen ( 1 5 ), in subdivision of Blocks 10, 15, 22 and 27, Brooklyn Addition to Oklahoma City, Oklahoma County, Oklahoma,
according to the recorded plat thereof;
2. Plaintiffs' has performed all duties under the contract which has become due, and stand ready, willing and able to perform and close the sale in accordance with the contract. A copy of the contract is attached as Exhibit A and incorporated;
3. Defendant has stated unequi vocally that she wi l l not perform the contract, so that the contract has been breached:
4. Plaintiff seeks performance of the contract by specific performance, and requests jud gment requiring Defendant to perfom1 the contract, and tenders all future perfonnance as provided in the contract;
5. Plaintiff is entitled to equitable relie( and has no adequate remedy at law.
WHEREFORE, Plaintiffs pray for judgment requiring Defendant to perform the contract, for the cost of pursuing the claim, including a reasonable attorney fee, and for such other and further relief as this Court deems just.
