Description:
Derald Ahlschlager and 78 other former Lawton School District teachers and employees sued the District for bad faith and breach of contract for discontinuing the payment of retirement benefits in 2002. The Plaintiff has taken early retirement under and incentive plan but when the District ran short of money because of a cut back in state funding, the board voted unanimously to stop making the promised payments. Plaintiff claimed that their were ways for the District to fund and pay the retirement benefits but failed and refused to do so.

Defendant claimed that it was not required to make the payments when it did not have the resources to do so under the terms of the agreements signed by the retirees which was the case when it was hit with the loss of $9.2 million in state funding.

Outcome:
Plaintiffs' verdict for $1.4 million.
