Description:
Medical malpractice claim by the family of 5-year-old girl born with a heart defective that the plaintiff's claimed should have been diagnosed in utero. Debra Yepez was sent to Englewood Hospital for an ultrasound. The technician who performed the test reported that he was not able to view all four chambers of the fetus' heart. No repeat or follow-up examination was performed and Dayna Yepez was born with a deformed left ventricle. Dayna suffered from developmental disabilities as a result of the heart defect. Her parents on her behalf and for themselves claimed that the doctors should have ordered another ultrasound.
Outcome:
Settled for $4.2 million.
