Description:
Wayne Graves, Mary Graves and Will Graves sued Toyota Motor Corporation on a products liability theory claiming to have been seriously injured in a rollover accident in 2009. Will Graves fro driving on U.S. Highway 84 in Jones County, Mississippi when his 1995 Toyota 4Runner sports utility flipped over several times. He suffered spinal injureds that left him paralyzed from the sternum down.
Plaintiffs claimed that the Toyota was defective and unreasonably dangerous as designed and manufactured by Defendant. Plaintiffs claimed that the vehicle had a propensity to overturn under certain situations because of hits high center of gravity and likelihood of roof crushing down into the passenger compartment during a rollover accident.
Toyota claimed that the vehicle was not defective or unreasonably dangerous and that the sole cause of the accident to Will Graves' driving. It also claimed that the vehicle's tires were under-inflated.
Plaintiffs claimed that the Toyota was defective and unreasonably dangerous as designed and manufactured by Defendant. Plaintiffs' verdict for $7.3 million. The jury found that Will Graves was 40% at fault in causing the accident.
