Glen Strong of Bay St. Louis, Mississippig sued DuPoint on a negligence theory claiming that he developed a rare form of blood cancer as a result of ingesting titanium dixoide released by DuPont into Bay St. Louis from its manufacturing plant. Strong claimed that he ingested the titanius dioxide, a white pigment used in paint, toothpaste and other products, as a result of eating oysters from the bay on a regular basis.
DuPont denied Strong's claims and asserted that there was
no way to prove that titanium dioxide caused the cancer that he developed.
Outcome:
Plaintiff's verdict for $14 million including $1.5 million in loss of consortium damages.
