Description:
Construction contractor who turned in the lowest bid (by about $5,000) on a public improvement project and a taxpayer sued the city, who awarded the contract to the second lowest bidder.



A consulting engineer hired by the City concluded that KAT would be able to complete the contract on time, but the Board of the City of Belton decided to award the contract to Dennis Johnson and the mayor immediately signed an ordinance providing approval.



Judge ruled in favor of the city. Plaintiff appealed.
