Springfield, MO - Doctor gets $750,000 verdict in her favor from jury



Dr. Hyewon "Helen" Kim, a radiation oncologist, sued Mercy Clinic Springfield Communities on a breach of contract wrongful termination theory claiming that her relationship with the defendant was terminated because she complained about substandard care provided to patients. She alleged that poor care was provided to:



a breast cancer patient receiving radiation and chemotherapy from two doctors that resulted in severe side effects, including a “severe radiation burn to the chest well, requiring more than two weeks of treatment interruption;”



a lymphoma patient receiving chemotherapy and radiation at the same time from the same two doctors when chemotherapy alone is the standard regimen; the dual treatments “caused the patient to have less chance of a cure,” and bad side effects;



a patient with brain cancer receiving both chemo and radiation from the same two doctors, causing the patient to have to stay in the hospital until his death when “He should have been treated with radiation therapy alone, and the treatment course should be short, such as two to three weeks, rather than seven to eight weeks.”



The defenses asserted by the Defendant are not available.
