12/04/2013 Motion Denied

On July 9, 2013, the defendant filed a Motion to Suppress his statements to police regarding the events of the death of W.N. There was a hearing held on October 23, 2013, and the issue was taken under advisement. Suggestions were filed on this issue with the court. The defendant was read his rights at the beginning of the interview by the police. The Court finds the defendant did understand his rights. The defendant did voluntarily and knowingly waive his rights to remain silent and the right to speak to an attorney. The totality of circumstances during the interview establishes that the defendant understood his rights and understood he was waiving defendant's rights under Miranda. The defendant also contends he was in such a state of hunger and emotion that he could not be competent to understand, waive his rights and then give a statement to the police. Under the totality of the circumstances, the Court finds the defendant was competent at the time of his statement; that defendant's statement was voluntarily made to the police. The Court overrules defendant's Motion to Suppress his statement. Notice of Entry to PA Patterson/Atty Biemdiek/Atty Wolfrum. CRH/env
