Amy Hadley's home was badly damaged when local law enforcement executed a search warrant looking for a fugitive they incorrectly believed was inside her home. When both the City of South Bend and St. Joseph County declined to pay for the $16,000 in resulting damages, Hadley sued for compensation under the Takings Clause of the Fifth Amendment to the U.S. Constitution.
Hadley filed suit in Indiana state court, St. Joseph County removed the action to the federal district court in
South Bend. After removal, defendants City of South Bend, the South Bend Police Department, St. Joseph County, the St.
Joseph Police Department, and the St. Joseph Board of Commissioners moved to dismiss.
