Description:
Breach of contract - exclusive real estate listing agreement. On January 28, 1994, Goodman signed an exclusive real estate listing agreement with Frolik and Co. Goodman also agreed that the commission would be paid if, within 90 days of the termination of the agreement, the property was sold "to any person to whom the property had been submitted during the term of the agreement. After the listing agreement expired, Goodman sold the property to a couple who had submitted an offer on the property during the period of the agreement. Plaintiff made demand for its commission, which Goodman refused.
Outcome:
Directed verdict for plaintiff for the amount of the commission.
