Description:
Negligence, Premises Liability Suit between Landlord/Tenant - Plaintiffs James Russel and Terri Johnson were tenants at Royal Creek Apartments managed by Defendant, Parkford Management Company, Inc. Plaintiffs claimed that they reported harrassment by another tenant, Michael Cole, to Parkford's management personnel on several occassions. The tenants claimed that the assistant manager stated that she would take care of the situation. The management personnel refused to disclose Cole's apartment address to Russell and advised Russell to report the matter to the police. Cole later stabbed Russell in the neck with a knife and kicked Johnson in the ribs during an altercation at the apartment swimming pool. Tenants claimed that Parkford breached its duty of care by failing to keep the premises safe and by negligently and recklessly failing to take reasonable and prudent measures to ensure their safety.
