Michael DeMartino sued Frank Murphy, John Minardi and John Minardi
on an excessive use of force theory, 42 USC 1983, with the result that his
civil rights were violated. He alleged that the
three New Haven police officers used
excessive force while arresting his for suspected car
theft six years ago.
He claimed that officer Pasquale Marino repeatedly struck
him with his flashlight and his police radio.
Marino testified he never hit DeMartino with his flashlight.
He admitted that he struck DeMartino about four times
with his radio after DeMartino punched him in the face
and tried to gouge his eyes.
