Kylie Asam, et al. sued Rudolph Ortiz on an auto negligence theory and his employer, Bhandal Bros. Trucking, on a respondeat superior theory claiming that Ortiz caused the car wreck that killed her family. Kylie was a passenger in an SUV that hit the semi-tractor trailer rig illegally parked on the side of a freeway in the early morning darkness without leaving on any lights or emergency reflector.
The plaintiffs claimed that Ortiz pulled over to sleep in violation of signs limiting stopping to emergencies on November 22, 2009.
Defendants denied wrongdoing and claimed that an "emergency" was the reason that Ortiz stopped his truck.
The SUV caught on fire and Kylie saw her parents and siblings burn to death in the crash wreckage.
