Description: Personal Injuries - Plaintiff brought this action against housing authority when assailants allegedly broke into building and caused personal injuries to the plaintiff. The action was brought to recover damages from the housing authority.

Outcome: A jury found the defendant 100% at fault in the happening of the accident, and is in favor of the plaintiff on the issue of liability. An order of the same court dated April 28, 1997 granted the plaintiffs motion to set aside certain portions of the jury verdict on the issue of damages and for a new trial on the issue of damages unless the defendant stipulated to increase certain damage awards, and denied defendants cross motion pursuant to CPLR 4401 to set aside the jury verdict and for judgment in its favor dismissing the complaint.
