Description: 1. That on or about June 7, 2012, at or iiear South Blackwelder Avenue mid S.W. 5gth Street in Oklahoma City, Qk3ahoma County, State of Oklahoma, Defendant negligently drove his motor vehicle causing Plaintiff to sustain injury arid damages.

2. As a result, Plaintiff’s were injured, were prevented from transacting business, suffered past, present and future mental and physical pain and suffering, temporary and permanent physical injuries, temporary and permanent physical limitations, iacurred expenses for medical treatment and suffered lost quality of’ life.

3.. The collision and said injuries and harm were the direct and proximate result of the carelessness and isgligence of the Defendant because the Defendant:

a. failed to use ordinary care to prevent injury to other persons;

b. failed to exercise ordinary care in keeping a lookout consistent with the safety of other vehicles and persons;

c. failed to devote full time and attention to driving; iid was traveling at an unsafe speed.

WHEREFORE, premises considered, Plaintiffs pray for jndgmçnt against the Defendant, in the amoinit of SI0,000.O0 for Joel Rodriguez and $10,000.00 for Joel Sambruno plus interest, costs and attorney’s fees along With any other relief this Couft deems just and equitable.

Outcome: ON this 29th day of March, 2013, this Order is made supplementary to Joint Application for Court Approval of Settlement and for Court Order of Dismissal With Prejudice of even date, pursuant to 12 O.S.A. (1984) §83.

Immediate withdrawal in the amount of $5,321.50 for the benefit of Plaintiffs’ attorney is hereby authorized.

Immediate withdrawal in the amount of $1623.00 for payment of medical bills for Joel Rodriguez is hereby authorized.

Immediate withdrawal in the amount of $412.50 for payment of medical bills for Joel Sambruno is hereby authorized.

Check or draft in payment of the settlement agreement in the sum of $6,169.54ior the benefit of the minor Plaintiff, Joel Sambruno, shall be deposited in IBC and shall not be withdrawn without Order of the Court authorizing the withdrawal until the minor reaches the age of eighteen (18) years.

Check or draft in payment of the settlement agreement in the sum of $5,727.00 for the benefit of the minor Pand shall not be withdrawn without Order of the Court

It is directed that Thomas B. Corbin shall have the responsibility of delivering a copy of this Order to the above-named depository, at the time the deposit is made.


This case shall be transferred to the Probate Division of the District Court of Oklahoma County for supervision concerning withdrawal from this depository.
