Description: Megan Hernandez, a minor child, by and through Amy Hernandez, as parent and next friend of Megan Hernandez, and Amy Hernandez, individually sued Margaret Sheppard claiming:

1. On or about January 25, 2012, in Cleveland County, Oklahoma, near the intersection of 121h Avenue and Rock Creek, Norman, Oklahoma, Defendant Margaret Sheppard was operating a vehicle and collided with a vehicle in which Plaintiff Megan Hernandez was a passenger.

2. Plaintiff Megan Hernandez was injured in said accident.

3. The negligence of Defendant Margaret Sheppard caused or contributed to the personal injuries of Plaintiff Megan Hemandez.

4. Plaintiff Amy Hernandez is the mother of Plaintiff Megan Hernandez.

5. As a Result of said accident, Plaintiffs pray for judgment against Defendant ri a sum in excess of $14,000.

Outcome: NOW on this 27th day of August, 2012, this cause came on before me, the undersigned Judge of the District Court of Cleveland County, State of Oklahoma, pursuant to agreement of all parties, Plaintiff Megan Hernandez minor child, by and through Amy Hernandez as parent and next friend of Megan Hernandez and Amy Hernandez, individually, appearing in person, Pro Se, and the Defendant appearing by her counsel of record. It was thereupon stated to the Court by the Plaintiffs and Defendant’s attorney that a settlement agreement had been reached, the terms of which the Defendant has agreed to payto Megan Hernandez minor child, by and through Amy Hernandez as parent and next friend of Megan Hernandez and Amy Hernandez, individually, the sum of $14,500 on the cause of action. It is stated to the Court that there are still the following outstanding medical bills: a bill of $12,526.00 due to Norman Regional Health System and a bill of $645.00 due to Medical Business Bureau (a collections agency), and a bill of $71820 to lngenix Subrogation Services. This leaves an extra $610.80 beyond that which is owed for
outstanding medical bills. It is further stated to the Court by all parties that the settlement agreement was fair and reasonable and was freely and voluntarily entered into by all concerned, and that all parties wish to have the Court approve the said settlement.
Whereupon, the Court proceeded to hear evidence from the parties and finds that the settlement is in the best interest of the minor child and should be approved and judgment entered thereupon.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that settlement is in the best interest of the minor child and that the settlement entered into between the parties and as explained to the Court is hereby approved.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that $12,526.00 shall be sent to Norman Regional Health System, that $718.20 shall be sent to Ingenix Subrogation Services, and $645.00 shall be sent to the Medical Business Bureau for outstanding medical bills.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED pursuant to Okia. Stat. tit. 12, § 83, the remaining proceeds of $610.80 for the minor child, Megan Hernandez, as settlement and judgment shall be deposited in Republic Bank & Trust and shall not be withdrawn without order of the Court authorizing further withdrawal or until minor Megan Hernandez reaches the age of majority.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that settlement is in the best interest of the minor child and that the settlement entered into between the parties and as explained to the Court is hereby approved.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that this case is transferred to the probate division of the District Court for further supervision concerning withdrawal of funds from the depository.
