Description: Crystal Dawn Butler sued Jeff Smith, The Police Chief of the City of Clayton and The City Council of the City of Clayton on negligence theories clamining that on August 1, 2009, Jeff Smith, while on duty as a Clayton, Oklahoma Police Officer, responded to a disturbance call outside his jurisdiction in Clayton, Oklahoma where he arrested Butler illegally and without probable cause in violation of Article II, Sections 2, 7 and 30 of the Oklahoma Constitution, the Fourteenth Amendment of the United States Constitution, and 42 U.S.C. 1983.

Outcome: Judgment against the City of Clayton, Pushmataha County in the amount of $87,800.00 including $75,000 in damages, $300 in costs and $12,500 in attorney fees.
