Description: Direct Traffic Control, Inc. sued Savona Kidd on an auto negligence theory claiming that on August 17, 2009 Defendant was driving her car on I-40 Westbound in Oklahoma City when she swerved left of center and lost control of her vehicle and struck a sign owned by Plaintiff that was being used for traffic control on the highway. Plaintiff claimed that Defendant failed to exercise due care in the operation of her vehicle. Plaintiff sought $15,301.25 in damages to its property and attorney fees under 12 O.S. 940.
Defendant admitted that the accident occurred but claimed that she was confronted with a sudden emergency and acted with reasonable care under the circumstances.
