Description: Route 66 Trader Market LLC dba Laser Expedition sued Seneca Insurance Company, Inc., Western Claims, Inc. and Lou Barbaro on claiming that on February 10, 2009 property owned by it in Canadian County, Oklahoma was damaged by a wind and hail storm, a covered peril under an insurance policy issued to it by Seneca. Plaintiff claimed that Barbaro was an agent for Seneca.
Plaintiff claimed that Defendants were unreasonable in their investigation, evaluation and payment of Plaintiff's claim and that said unreasonable conduct constituted bad faith for which extra-contractual damages should be paid.
Plaintiff sought compensatory and punitive damages from Defendants.
Seneca admitted that it issues a policy to Plaintiff and that Plaintiff's property was damaged and a claim made but denied all other allegations.
Outcome: Dismissed without prejudice as to Western Claims and Lou Barbaro. All other claims remain for trial on the merits.
