Description: Terry Moore, individually and as next friend of Jerrit Moore, a minor, sued Robert Blackwell on an auto negligence theory claiming that on September 1, 2007 Jerrit Moore was walking on the far outside of the I-35 service road near Franklin Road in Cleveland County when he was struck by a vehicle driven by Defendant. The cause of the car wreck was the negligence of the driver and not the pedestrian, Moore.
Defendant claimed that Mr. Moore was walking down the middle of the road and were not wearing any reflective clothing, had no lights and gave not warning of their presence in the roadway. Defendant denied any fault on his part in causing or contributing to the accident that injured Mr. Moore.
Outcome: Defendant's verdict.
