Description: Chicago, Illinois criminal defense lawyer represented defendant charged with persuading or attempting to persuade more than a dozen underage girls to send him sexually explicit images of themselves.

THOMAS VIVIRITO admitted in a plea agreement that in 2018 and 2019 he used Instagram, Snapchat, and text messaging services to persuade or attempt to persuade the minor girls, some of whom were as young as 12 years old, to send him sexually explicit photos and videos. Vivirito admitted that in some instances he instructed the victims on what type of sexually explicit conduct should be portrayed in the visual depictions of themselves.

Vivirito, 27, of Oak Brook, Ill., pleaded guilty earlier this year to a federal child pornography charge. U.S. District Judge Virginia M. Kendall imposed the sentence Friday after a hearing in federal court in Chicago.

The sentence was announced by John R. Lausch, Jr., United States Attorney for the Northern District of Illinois; and Emmerson Buie, Jr., Special Agent-in-Charge of the Chicago Field Office of the FBI. Valuable assistance was provided by the Naperville, Ill., Police Department, and the Will County State’s Attorney’s Office.

Outcome: The defendant pleaded guilty to Count(s)3 of the Indictment. The remaining counts are Dismissed on the motion of the United States. The defendant is hereby committed to the custody of the Federal Bureau of Prisons to be imprisoned for a total term of: Two hundred and sixteen (216) months as to Count 3 of the Indictment. The court makes the following recommendations to the Bureau of Prisons: that the defendant be incarcerated at the Federal Medical Center in Rochester, Minnesota. That the defendant participate in the Residential Drug and Alcohol Treatment Program (RDAP) and Sex Offender Treatment Program while incarcerated. That the defendant be prescribed DuPixent (dupilumab) while incarcerated. The defendant is remanded to the custody of the United States Marshal. Upon release from imprisonment, you shall be on supervised release for a term of: Ten (10) years as to Count 3 of the Indictment. Criminal Monetary Penalties. Schedule of payments.
