Description: Albuquerque, New Mexico criminal defense attorney represented defendant charged with armed robbery of a pharmacy and theft of medical products and possession with intent to distribute Oxycodone and Alprazolam.

Joseph Matney, age 41 entered and robbed an Albuquerque pharmacy on Jan. 31, 2018. Matney and a juvenile accomplice held the employees at gunpoint and demanded opioid painkillers, anxiety pills and money from behind the counter. They fled with more than 2,500 pills before law enforcement arrived. On Feb. 12, 2018, law enforcement in Denver, Colorado, arrested Matney after searching his vehicle and finding 1,600 of the stolen prescription pills and a firearm.

The Drug Enforcement Administration and the Albuquerque Police Department investigated this case with assistance from the Denver Police Department. Assistant U.S. Attorney Peter J. Eicker prosecuted the case.

Outcome: SENTENCE IMPOSED: CBOP: 216 months; 132 months as to Counts 1 and 4; Counts 1 and 4 shall run concurrently to each other; 60 months as to Counts 3 and 5; Counts 3 and 5 shall run concurrently to each other and concurrently to Counts 1 and 4; 84 months as to Count 2; Count 2 shall run consecutive to all other Counts for a total term of 216 months; SUPERVISED RELEASE: 5 years as to Count 2; 3 years as to Counts 1, 3, 4, and 5; said terms shall run concurrently for a total of 5 years with Special Conditions; RESTITUTION:1,556.04; Pursuant to the Mandatory Victim Restitution Act, it is further ordered that the defendant will make restitution to Phils Pills Pharmacy in Albuquerque in the amount of $724.04, and to Sams Regent Pharmacy in Albuquerque in the amount of $832. The total amount of restitution ordered in this case is $1,556.04. The restitution will be paid in monthly installments of $100 or 15% of the defendants gross monthly income, whichever is greater; SPA: $500.00; Defendant remanded into custody
