Thomas Clemons, age 37, sued the Cook County Sheriff's Office and Thomas Dart on a civil rights violation theory under 42 U.S.C. 1983 claiming that his 8th and 14th Amendments Constitutional Rights were violated when he was held in the Cook County jail from September 23, 2012 to March 9, 2013. Plaintiff, who is paralyzed claimed that he was prevented from taking a shower and emptying his colostomy bag.


Defendant denied wrongdoing.

Plaintiff was paralyzed when he was shot in 2003 and later both of his legs were amputated. He claimed that the cells in which he was kept did not comply with the Americans With Disabilities Act.

Outcome: Plaintiff's verdict for $950,000.00.
