Description: This was a medical malpractice case arising out of the birth of Gatlin Swinton at Cushing Regional Hospital on June 2, 1996. Dr. Belford delivered Gatlin and Dr. Kimmel did the resuscitation. Plaintiffs allege Gatlin suffered severe and permanent brain damage due to the negligence of the Defendants.

Dr. Belford and Dr. Kimmel denied plaintiffs' contentions and contend that they provided medical care in compliance with the applicable standards of care and that their care and treatment did not cause harm to Gatlin Swinton.

Outcome: VERDICT FORM 1 in favor of plaintiffs and against defendant Guy Belford, M.D. Dollar amount awarded plaintiffs' award: $616,400.00. Dollar amount awarded to Plaintiffs in damages as Co-Guardians of the Estate of Gatlin Swinton, a minor in the sum of $3,200.000.
