Tacoma, WA - Judy and Chuck Cox, the grandparents of Charles and Braden Powell, individually and on behalf of the The Estates of Charlie and Braden Powell sued the Washington Department of Children, Youth and Families on wrongful death theories claiming that they childrens' deaths were directly caused by the failure on the part of the Defendant to exercise due care in dealing their father, who killed them.
The children were taken to Josh Powell's Pierce County home by a DSHS caseworker for a supervised visit. He locked the caseworker out of the house, killed the boys with a hatchet and then killed himself in an exp0losire fire that destroyed the home.
The boys' mother disappeared in 2009. Her body was never found and Josh Powell was never charged.
Outcome: Plaintiffs' verdict for $98 million.
