Description: Ariel and Deborah Levy sued Legacy Health System. on a medical negligence (medical malpractice) theory claiming that they were provided substandard care and, as a direct result, their daughter was born with Down syndrome even though a prenatal test found she didn't have the chromosomal abnormality. The claimed that Deborah would have aborted her pregnancy had she known her daughter had the chromosomal abnormality. They claimed that Legacy's Center for Material-Fetal Medicine in North Portland and a Legacy laboratory for botching the test.
Legacy Health System denied that it was negligent. It claimed that the test results show the girl had a normal genetic profile because she has mosiac Down sysndrome meaning a significant number of her cells don't contain an extra 21st chromosome.
Outcome: Plaintiffs' verdict for $3 million.
