Description: Alyssa Burrage sued Gibson Sotheby’s International Realty on a fraud theory claiming that she was misled by the defendant when it concealed from her that the downstairs neighbor at the condominium that she bought smoked cigarettes. Plaintiff claimed that he smoke from the unit below her unit aggravated her asthma. Burrage, age 32, claimed that she noticed the smoke when they visited the condo in Boston's South End in 2006. She claimed that the broker asserted the the smell of smoke must be coming from the owner of the unit and that it would go away over time if Plaintiff purchased the unit and did not smoke in it.

Defendant denied wrongdoing.

Outcome: Defendant's verdict.
