Description: David Frye sued former McDowell County North Carolina Deputy Sheriff Brandon Watson, Sheriff Dudley Greene and McDowell County on a governmental tort claim theory for the wrongful death of his 2-year-old daughter Kennedy Frye who was killed on February 6, 2007 when the deputies patrol car ran into the back of the car in which Kennedy was a passenger at an estimated 120-mph. Kennedy's mother was also severely injured in the crash and the combined medical expenses for the two eventually reached $1.5 million.
The post accident investigation of the crash determined that Deputy Brandon was writing an address at the time of the accident, did not have his emergency lights or siren on and had the dome light in the car turned on at the time. He resigned his commission and pled guilty to misdemeanor death by vehicle and reckless driving.
The defenses asserted by the defendants are not available.
Outcome: Plaintiffs' verdict for $5.5 million.
