Description:
Tulsa, Oklahoma Indian law lawyers represented the Defendant seeking a declaratory judgment that the Defendant lacked jurisdiction over Indians who commit traffic offenses in the Creek Reservation.
The Creek Nation also asked the Court to enjoin Defendant from exercising this jurisdiction without excess authorization from Congress.
The Defendants moved to dismiss, arguing that they action was premature because "the law regarding jurisdiction over Indians is unsettled, continually evolving, and the subject of several pending lawsuits in both state and federal courts.
The parties settled their dispute and filed a stipulation of voluntary dismissal without prejudice.
The City agreed to not to prosecute Muscogee Nation members within the boundaries of the Nation's reservation. It took the position that it has jurisdiction to prosecute tribal members but agree not to do so on policy reason.
The State of Oklahoma sought to have the case dismissed or, in the alternative, to intervene.
