Rodney Burch brought claims under 42 U.S.C. § 1983 for First Amendment retaliation and the Idaho Protection of Public Employees Act, Idaho Code § 6-2104, based on the theory that England took adverse employment actions against Burch as a result of Burch's protected speech made while he was the Public Works Director.
