Description:

Theresa Spencer, Individually and as Natural Guardian of AS, a Minor Child, sued Billy Joe Dempsey on an auto negligence theory claiming that she and her child were injured in a car truck wreck caused by Dempsey. Plaintiff also sued MSJ Trucking, Inc. on a respondeat superior theory and its insurance carrier, National Specialty Insurance Company, claiming that Dempsey was acting on the trucking company's behalf at the time of the accident.
