After a three-day jury trial, Robert Kennedy was convicted of possessing a firearm as a convicted felon, see 18 U.S.C. §§ 922(g)(1) and 924(a)(2); possessing heroin with the intent to distrib-ute it, see 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(C); and possessing a firearm in furtherance of a drug trafficking crime, see 18 U.S.C. § 924(c)(1)(A)(i). Based on his prior Georgia convictions for burglary, possession of marijuana with intent to distribute, and possession of methamphetamine with intent to distribute, Kennedy was treated as an armed career criminal and a career offender. See generally 18 U.S.C. § 924(e); U.S.S.G. § 4B1.1(a). Because of that his guidelines range was 420 months to life imprisonment. He received a below-guidelines sentence of 360 months.

The Defendant was found guilty and was sentenced to 360 months imprisonment followed by 3 years supervised release to run concurrent to Count 23s and 24s, for a total term of 3 years supervised release, and a $100 mandatory assessment fee.
