Rob Heroy (en espanol) solves problems. Big problems. He is an aggressive trial attorney with significant trial experience. He believes that standing up to the Government provides his clients with the best possible results. He left a prominent Charlotte law firm to join Goodman Carr as a partner in January of 2012. Prior to that, he served as an assistant district attorney in the Mecklenburg County District Attorney's Office. Rob represents clients in criminal matters in state and federal courts. He handles high-stakes criminal matters such as white collar criminal charges and investigations, large-scale drug trafficking conspiracies, weapons violations, serious assaults, and homicides, and is not afraid of trial. He represents individuals who have been federally indicted or targeted for drug and weapons charges, immigration offenses, and white collar crime. His work frequently involves representing individuals and companies who are the subjects or targets of state and federal criminal investigations and want to know their options within the law, and what steps can be taken early on to stay ahead of the game and protect themselves. And there are frequently a number of valuable options. He has worked on criminal and immigration cases in dozens of states as well as foreign countries. His cases have been prominently featured in media including the L.A. Times, MSNBC, CNN, the Charlotte Observer, and Geraldo at Large. He was recently recognized in a novel by a nationally-recognized journalist for his assistance in contributing to the author's knowledge of organized crime in the Charlotte area. He is frequently invited to speak at continuing legal education seminars on criminal law topics. Rob also represents individuals on a wide range of immigration matters in immigration courts. Additionally, he represents detainees in the immigration courts and has challenged their detention through habeas corpus proceedings in both state and federal courts. In a number of cases, he has been able to obtain post-conviction relief for criminal convictions which have allowed his clients to remain in the country. He frequently presents at CLE's on the subject of immigration law. He has been accepted to testify as an expert witness in the area of immigration law in Mecklenburg County Superior Court. He is experienced in state and federal criminal appeals, including the North Carolina Appellate Courts, the Board of Immigration Appeals, and the Fourth Circuit Court of Appeals. Between those courts, he has handled over 50 appeals. In 2013 and 2014, he obtained reversal of a client's 35-year drug trafficking sentence in the N.C. Court of Appeals, obtained a 100-month sentence reduction on remand for another State client, and obtained a remand for resentencing from the Fourth Circuit for a 2-year reduction for another client. (read more). In 2015, in another published decision, he obtained reversal by the Court of Appeals of a juvenile's felony convictions based on a failure to properly obtain a confession by the police. (read more). He has an active post-conviction practice which includes motions for appropriate relief, 2255 motions (habeas corpus), and motions to reopen. In 2012 and 2013, he successfully overturned a federal weapons conviction in the Eastern District of North Carolina, which the Government unsuccessfully appealed to the Fourth Circuit, numerous state felony drug and weapons felonies in Mecklenburg County, a felony obstruction of justice charge in Gaston County, on top of numerous misdemeanor charges. In addition, he successfully obtained a remand for another federal client and obtained a 20 month reduction in sentencing, and represented another client on remand where he obtained an 8 and a half year reduction in his sentence. In 2014 and 2015, he overturned felony convictions for various individuals, allowing them to maintain their legal status in the United States. In 2016 he has already overturned a 20-year sentence for an individual who received ineffective assistance at trial by his prior attorney, and the year is still young. Business North Carolina Magazine selected Rob to the Legal Elite in 2010, 2011, 2012, 2013, 2014 and 2015 for criminal defense, an award in which Business North Carolina polls attorneys to vote for the top 3 percent of attorneys in their field. North Carolina Super Lawyers selected him as a Rising Star in criminal defense for 2013. Martindale Hubbell has rated him as an AV Preeminent lawyer, their highest rating for legal ability. Martindale also lists him as having a 4.9 out of 5.0 client rating. He has a 10 out of 10 attorney rating on Avvo.com. He was selected to the Mecklenburg County Bar Leadership Institute in 2011. Rob is the co-president of the criminal defense chapter of the Mecklenburg County Bar. He is an adjunct professor at the Charlotte School of Law where he teaches classes on appellate practice and advanced criminal practice. Outside of the law, he was a finalist in the 2010 World Series of Poker and is an active cross-fitter. He is married to Katie Heroy, and they have three little boys, Linus, Arthur, and Leo. He is also the founding member of The Adventure Club, which explores the world and whose members are limited to Rob, Katie, Linus, Arthur, and Leo.
