Kristen is an experienced business litigator and one of the founding partners of Torres, Scammon & Day LLP. In her more than 15 years of litigation practice at two of the country’s largest law firms, most recently Boston’s Mintz Levin, Kristen has successfully handled litigation for both businesses and individuals in a number of different areas, including breach of contract, Civil RICO, consumer protection and license disputes. She has appeared in both federal and state trial courts in Massachusetts, the First Circuit Court of Appeals, as well as at mediations and arbitrations. Kristen maintains a “big picture” litigation philosophy, understanding that a particular dispute is but one of many considerations for the business or individual involved. Kristen litigates with an eye toward helping her clients efficiently and successfully achieve their business and litigation goals. Kristen has specialized expertise in White Collar Defense and Investigations. She has extensive experience representing corporate and individual clients in cases involving allegations of securities fraud, false claims, mail fraud, federal highway fraud, false statements, antitrust violations, public corruption, campaign finance violations and tax evasion. She has represented clients at all stages of government investigations, including subpoena compliance, grand jury appearances, jury trials and sentencing. Many of Kristen’s successes in this area are publicly unknown, since her work representing clients during grand jury and other government investigations has often led to clients not being charged criminally. Her successful public representations include: Kristen was part of the trial team that secured the acquittal by a jury in the U.S. District Court for Massachusetts of a former CEO charged with federal income tax evasion after an extensive investigation into stock options backdating at his former company. After she was retained solely for federal sentencing proceedings, Kristen’s client, who had previously plead guilty to copyright infringement, received a sentence significantly below the sentencing guidelines and the sentence requested by the Government. The construction industry is one of Kristen’s areas of significant experience and expertise. While at Mintz Levin, she represented three Big Dig contractors in fraud investigations and corresponding debarment proceedings before the Federal Highway Administration and the Massachusetts Department of Transportation. She has represented general contractors, subcontractors and materials suppliers in a variety of disputes with the government, from regulatory matters to criminal investigations and prosecutions. Kristen has a keen understanding of the areas of risk for construction industry participants who work on publicly-funded projects. Kristen has also assisted clients with internal investigations and corporate compliance matters, including compliance auditing and compliance program development. She has particular expertise in compliance matters for public contractors, developing strategies to avoid liability for failure to comply with regulations and contractual specifications.
