| Lofgreen, Victor D. - Chicago, IL Mitigation issues include the complex interaction of sociological, developmental, environmental, psycho-pathological, socio-biological, genetic, and neural-chemical, factors derived from a comprehensive analysis of the individual. We develop this kind of comprehensive data and analysis for the Defense Counsel to use for plea negotiation and the sentencing hearing to support a request for a downward departure from the sentence recommended by the prosocutor. Each case is unique and requires data collection and analysis from a variety of sources. Interviews of the defendant and other key persons are conducted. We review the defendant's biological, psychological and social history. Based on this review the need for specific medical, psychological / psychiatric, and developmental evaluations is established and the assessments are completed. Utilizing this broad spectrum of information, we prepare a case study which supports attorney's defense strategy. A defense oriented Sentencing Plan is prepared utilizing this information as a way to target treatment, developmental, restitution and community alternatives to incarceration. This process leads to a sentence that is more appropriate to the defendant, the offense committed, and the safety of the community. |
