Description: Enid, OK - Alec Phillip Ramirez sued Julie K. Whittington on an auto negligence (car wreck) theory claiming:

COMES NOW the Plaintiff, and for his cause of action against the above named Defendant, alleges and states as follows:
1. That on or about June 13, 2013, Plaintiff Alec Ramirez was operating his vehicle in Garfield County, Oklahoma.
2. Plaintiff’s vehicle was southbound in the 1900 block of South Van Buren as he approached the intersection of West Rupe.
3. Defendant’s vehicle stopped at West Rupe, attempted to make a left turn, striking Plaintiff’s vehicle left of center on Van Buren.
4. Defendant admits that she was grossly negligent as she left the stop sign attempting to cross South Van Buren without having full knowledge that it was clear to do so.
5. That as a result of the negligence of Defendant, Plaintiff suffered bodily injuries, suffered pain of body and mind, and incurred expenses for medical attention for said injuries, with general and special damages totaling a sum in excess of $75,000.00.
6. Plaintiff further seeks punitive damage against Defendant for her gross negligence in attempting to cross South Van Buren without being sure that it was clear to do so. Plaintiff should be awarded punitive damages to deter Defendant and others like her from acting in same or similar manner, threatening the health, safety and welfare of others.
WHEREFORE, premises considered, Plaintiff seeks judgment against Defendant for both actual and punitive damages in an amount in excess of $75,000.00, plus attorney fees, court costs, prejudgment interest, postjudgment interest, and all other damages deemed just and reasonable.

Outcome: Settled and dismissed with prejudice.
