Description: Oklahoma City, OK - Raymond Martinez sued My Dentist Holdings, LLC, Advanced Dental Implant and Denture Center, Inc. d/b/a My Dentist on medical negligence (medical malpractice) and respondeat superior theories claiming:

1. On September 3, 2013, Plaintiff Raymond Martinez sought the services of Defendants for dental care and treatment. Specifically, Defendant, Lisa Truong, DDS, performed a molar root canal procedure on Plaintiff during which time an endodontie file was dropped down Plaintiff’s throat and into his body. As a result, Plaintiff required surgical intervention and was permanently injured.
2. At all relevant times, Defendant Lisa Truong, DDS, was acting as the agent servant and employee and within the course and scope of her employment with Defendants My Dentist Holdings, LLC, and Advanced Dental Implant and Denture Center, Inc., cl/b/a My Dentist.
3. Plaintiff Raymond Martinez’s injuries resulted from Defendants’ negligence as follows:
a. The care and treatment rendered by Defendants to Plaintiff Raymond Martinez fell below acceptable medical and dental standards.

b. Defendants failed to diagnose and treat Plaintiff Raymond Martinez’s medical condition and said failure was below acceptable medical and dental standards.
4. The endodontic file which was dropped down Plaintiff’s throat was under the exclusive care, custody and control of Defendants and/or Defendants’ agents, servants and employees. Injuries of the type sustained by Plaintiff do not ordinarily occur absent negligence. Plaintiff therefore invokes the doctrine of res ipsa loquitur as a further ground of recovery herein.
5. As a result of Defendants’ negligence, Plaintiff Raymond Martinez suffered personal injuries. Said injuries are permanent, painful, progressive and disfiguring. When injured, Plaintiff Raymond Martinez was 27 years of age with a life expectancy of 30,32 years. As a further result of Defendants’ negligence, Plaintiff Raymond Martinez has and will incur medical expenses, has and will lose earnings, has and will suffer pain of mind and body, and will be permanently disabled and disfigured, damaging him in an amount in excess of $75,000.00.
