Now on this 4th day of November, 2013, the Petitioners/Plaintiffs and Co-PetitionerlDefendant set forth above, jointly petition this Court approve a settlement agreement previously entered into between the parties, in accordance with 12 O.S. § 83, all as more Cully set forth below:
I. That on August 4, 2012, the minor party hereto was involved in a motor vehicle accident also involving an alleged uninsured/underinsured motorist. That as a result of the motor vehicle accident, the minor Petitioner/Plaintiff was allegedly injured; and, the minor and:the minor’s mother, Sonja Crawley and minor’s legal guardians and next friends, Tommy Hartlineand Michelle liartlinc (hereinafter relèrred to collectively as “Petitioners/Plaintiffs”), have asserted a claim against Farmers Ti-isurance Company, Inc. (“hereinafter referred to as CoPetitionerlDefendant”) pursuant to a policy of uninsured/underinsured motorist liability insurance under which the minor, Joshua Fountain, is alleged to be insured. The Petitioners/Plaintiffs’ claims are disputed both as to liability and damages. The parties have reached a compromise agreement in the amount of$ I 1,000.00 and have requested that the Court
approve the settlement.
2. That the Court fmd that Sunja Crawley, as Mother of Joshua Fountain, a minor and Tommy Hartline and Michelle Ilartline, Individually and as Legal Guardians and Next Friends of Joshua J”ountin, a minor, are the proper parties to act on behalf of Joshua Fountain, the minor child; that they are competent and should he appointed guardian ad litein.
3. A compromise agreement has been reached wherein the Co-Petitioner/Defendant has offered to pay to the Petitioners/Plaintiffs, and to the minor, by and through Petitioners/Plaintiffs the total sum olSi 1,000.00 for all necessary and incidental expenses, past and future, including attorney iees, interest, costs and medical expenses incurred or to be incurred because of thc alleged injuries to the minor Petitioner/Plaintiff, and for loss of love, services and affection of the minor child due to said alleged injuries, and both past and future, pennanent disability, disfigurement and any other claim thc minor child may have now, or which may arise in the future, known or unknown, resulting from the said accident.
4. Distribution of the total settlement amount of $11,000.00 should be in accordance with evidence submitted,
5. The attorney fees and expenses of Petitioners/Plaintiffs should be approved in accordance with evidence submitted.
6. ‘lommy Tlartlinc and Michelle Hartline, in their indiidual capacities and as legal guardians and next friends of the minor have agreed to be solely responsible for any and all outstanding medical bills, liens, attorneys fees and any other claims made against the settlement proceeds.
7. The Petitioncrs/Plaintiff believe the settlement is fair, equitable and in the best interest of the minor child and represent tc the Court that the settlement agreement was entered into free from fraud, duress or coercion by any of the other parties hereto or their agents, attorneys or employees, and that they have lhrrned their opinion with regard to this settlement based upon their OWl) indepcndeni beliefs and thoughts and not upon the representation of the CoPetitioner/Defendant.
8. The Petitioners/Plaintiffs are aware that this settlement, 11 approved by the Court, will fully compromise and conclude the subiect uninsurediunderinsured motorist litigation.
9. The Petitioners/Plaintifl’s are also aware that by settling this case the injured minor as ‘veil as Sonja Crawley. as mother, and Tommy 1-jardine and Michelle 1-lartline, as legal guardians, are giving up the right to proceed further with any civil action against the CoPetitioner/Defendant. If this civil action were continued, the Petitioners/Plaintiffs are aware that a jury could award either greater, lesser or the same compensation than that received by way of this compromise settlement.
